Please read these Terms of Service ("Terms") carefully before using the 3D3D website at 3d3d.ca (the "Website") or engaging our services. These Terms are a legal agreement between you ("Client," "you") and 3D3D, operated by Kenneth Murray McKnight in Fredericton, New Brunswick, Canada ("3D3D," "we," "us").

By accessing this Website or using our services, you agree to be bound by these Terms. If you do not agree, do not use the Website or our services.

1. Services

3D3D provides the following services:

  • Vessel Management: inspections, maintenance coordination, refit planning, documentation, vendor coordination, and project oversight
  • Custom Parts & Vessel Services: custom part creation using additive processes with marine-grade materials including PETG-CF, TPU, ASA, ABS, Nylon, PA-CF, and Polycarbonate
  • Field Deployment: on-site custom-part and technical support for marine, industrial, and remote operations
  • Software Development: custom software, AI systems, web applications, and IoT platforms
  • Race Campaign Support: embedded custom-part and systems support for offshore sailing campaigns

2. Use of the Website

You agree to use this Website only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Website in any way that violates any applicable federal, provincial, or local law
  • Attempt to gain unauthorized access to any part of the Website
  • Use any automated system (bots, scrapers) to access the Website without our express written permission
  • Introduce malicious code, viruses, or other harmful material

The Website is intended for individuals who are at least 18 years of age.

3. Quotes and Orders

Quote Process

All service engagements begin with a quote request via email. Quotes are provided free of charge and are valid for 14 days from the date of issuance unless otherwise stated. A quote is not a binding agreement until both parties confirm the scope, price, and timeline in writing.

Order Modifications

Changes to an order may be requested before work begins. Once work has started, modifications may not be possible or may incur additional charges. We will communicate any cost implications before proceeding.

Cancellation

You may cancel an order before work begins at no charge. Orders cancelled after work has started are subject to charges for materials used and labour performed. We reserve the right to cancel any order at our discretion, in which case we will refund any payments received.

4. Pricing and Payment

  • All website prices and quotes are in United States dollars (USD) unless a written quote states otherwise
  • Prices do not include applicable taxes (HST/GST). You are responsible for all applicable taxes
  • Payment terms are agreed upon per project and communicated in the quote before work begins
  • Deposits, milestone payments, or full upfront payment may be required depending on scope, materials, travel, and urgency
  • Final payment is due before final delivery, release of source files, shipping, or deployment closeout unless otherwise agreed in writing
  • We reserve the right to refuse, cancel, or limit any order for any reason, including suspected fraud, pricing errors, or product availability

5. Intellectual Property

Your Content

You retain ownership of all files, designs, 3D models, and specifications you submit to us. By submitting content, you grant 3D3D a limited, non-exclusive license to use that content solely for the purpose of fulfilling your order. We will not share, sell, or distribute your files to any third party.

Our Content

All content on this Website, including text, graphics, logos, images, and software, is the property of 3D3D or its licensors and is protected by Canadian and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.

Restricted Content

We reserve the right to refuse any order that involves:

  • Content that infringes on the intellectual property rights of others
  • Weapons, weapon components, or items designed to cause harm
  • Illegal items under Canadian federal or provincial law
  • Items that violate export control regulations

6. Warranty and Disclaimers

Limited Warranty

3D3D warrants that produced parts will be made in accordance with the agreed-upon specifications. If a part does not meet the agreed specifications due to an error on our part, we will replace or refund the part at our discretion.

Disclaimer

Except as expressly stated above, all services and products are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Additive parts have inherent material limitations. We do not warrant that parts are suitable for safety-critical, load-bearing, or pressurized applications unless expressly agreed in writing. The Client is responsible for determining the suitability of parts for their intended use.

7. Limitation of Liability

To the fullest extent permitted by law, 3D3D shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim arising from these Terms or our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.

8. Indemnification

You agree to indemnify and hold harmless 3D3D and its operator from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, your violation of these Terms, or your infringement of any third party's rights.

9. Force Majeure

3D3D is not liable for delays or failures in performance caused by circumstances beyond our reasonable control, including natural disasters, equipment failure, supply chain disruptions, power outages, internet outages, or government actions.

10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of New Brunswick and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New Brunswick.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of our Website or services after changes are posted constitutes acceptance of the revised Terms.
